Digital Charting products – Terms of Accces

(Applies to MRM, MPF, and all current and future Inratios analytical models)

1. Scope

These Terms of Access apply to all digital charting products, analytical models, and tools developed and distributed by Inratios, including but not limited to the Momentum Rotation Model (MRM), the Market Pattern Forecast (MPF), and any future models or tools.

2. Educational Use Only – No Financial Advice

All Inratios products are provided strictly for educational and informational purposes only.
They do not constitute investment advice, financial advice, or a recommendation to buy, sell, or hold any financial instrument.
Trading and investing involve substantial risk. Past performance is not indicative of future results.
Inratios products do not deliver real-time trading signals; they provide analytical visualisations to support market interpretation.

3. License

Access is granted under a personal, non-exclusive, non-transferable license.
Redistribution, resale, public sharing, or commercial use is prohibited without prior written consent.

4. Delivery & No Refunds

Products are delivered digitally, typically via TradingView invite-only access or downloadable files.
By accepting access, you agree to immediate delivery and waive any applicable right of withdrawal under EU Directive 2011/83/EU.
No refunds are issued once access has been granted.

5. User Responsibilities

Users must be 18 years or older.
Users are solely responsible for their actions, compliance with applicable laws, and interpretation of model outputs.
Users must ensure that using the product is legal in their jurisdiction.
Users acknowledge that digital charting products may experience interruptions due to technical issues (e.g., TradingView outages, server downtime). Inratios is not liable for such disruptions.

6. Limitation of Liability

The creator(s), Inratios, and affiliates are not liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to loss of profits, trading capital, data, or missed opportunities.
Liability is limited to the lesser of USD $500 or the amount paid for access.

7. Governing Law, Dispute Resolution & Class Action Waiver

These terms are governed by the laws of the Netherlands.
Disputes will be resolved exclusively in the competent court of Limburg, the Netherlands, unless binding arbitration is chosen.
Any disputes may be resolved via binding arbitration in the Netherlands under Dutch law, in English, with one arbitrator.
Class Action Waiver: Users waive the right to participate in any class, collective, or representative action.

8. Changes to Terms

Inratios reserves the right to update these Terms of Access at any time without prior notice. Continued use after updates constitutes acceptance of the revised terms.
